Trademomo reserves the absolute and unconditional right to refuse service, cancel subscriptions, or terminate access to any individual or entity at any time, for any reason or no reason, at our sole discretion. This includes but is not limited to individuals we determine are not financially or mentally suited for leveraged trading, are acting in bad faith, are competitors, or whose participation we deem inconsistent with our mission and community standards. No explanation is required and no refund will be issued in such circumstances beyond what is expressly provided in our Payment & Guarantee Policy.
ALL content, tools, indicators, strategies, live trade room sessions, Discord communications, email communications, social media posts, and any other materials provided by Trademomo are strictly for educational and informational purposes only. Nothing provided by Trademomo constitutes financial advice, investment advice, trading recommendations, or a solicitation to buy or sell any financial instrument.
You are solely responsible for all of your trading decisions. Trademomo does not manage accounts, does not provide personalized financial advice, and is not registered as an investment adviser with any regulatory body. Past performance demonstrated in any Trademomo content is not indicative of future results.
Upon payment of applicable subscription fees, Trademomo grants you a limited, non-exclusive, non-transferable, revocable license to use Trademomo's NinjaTrader indicators and strategy files solely for your own personal, non-commercial trading purposes on a single licensed NinjaTrader installation identified by your machine ID.
Violation of any restriction will result in immediate termination of your license without refund and may subject you to legal action including claims for damages, injunctive relief, and recovery of legal costs.

You assume all technology-related risks in their entirety. Trademomo's obligation is limited to making reasonable efforts to maintain and improve the software on an ongoing basis.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRADEMOMO, ELLEX CAPITAL INC., OR ANY OF THEIR OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOST PROFITS, LOSS OF DATA, OR ANY OTHER INTANGIBLE LOSSES, REGARDLESS OF THE CAUSE OR THEORY OF LIABILITY.
Trademomo's total cumulative liability to you for any claims arising from or related to these Terms, our software, or our services shall not exceed the total amount you paid to Trademomo in the thirty (30) days immediately preceding the event giving rise to the claim.
This limitation applies regardless of whether the damages were foreseeable and whether Trademomo was advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in such cases, our liability shall be limited to the maximum extent permitted by law.
ALL SALES ARE FINAL. Trademomo does not offer refunds under any circumstances, including but not limited to: dissatisfaction with results, trading losses, software performance, inability to use the tools, change of mind, or failure to pass a prop firm evaluation.
The Keep Trading Guarantee is the sole remedy available to subscribers and is governed exclusively by our Payment & Guarantee Policy. The Keep Trading Guarantee is not a refund — it is a billing pause subject to specific documented requirements.
Payment processing is handled by Whop.com. By subscribing, you also agree to Whop's terms of service available at whop.com/terms.
BY COMPLETING PURCHASE, YOU EXPRESSLY WAIVE YOUR RIGHT TO INITIATE A CHARGEBACK, PAYMENT DISPUTE, OR REVERSAL WITH YOUR CREDIT CARD ISSUER, BANK, OR PAYMENT PROCESSOR FOR ANY CHARGE MADE BY TRADEMOMO OR WHOP.COM ON OUR BEHALF.
If you have a billing concern, your sole remedy is to contact us directly at support@trademomo.com. We will make good-faith efforts to resolve legitimate billing errors.
Any customer who initiates a chargeback or payment dispute will have their access immediately and permanently terminated with no possibility of reinstatement. Trademomo reserves the right to pursue recovery of all disputed amounts plus associated fees, costs, and legal expenses through all available legal remedies. Initiating a chargeback in bad faith when no legitimate billing error exists may constitute fraud and will be treated accordingly.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of our services, or our software shall be resolved exclusively through binding individual arbitration. You expressly waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against Trademomo.
Arbitration shall be conducted on an individual basis only. You may not bring claims as a plaintiff or class member in any purported class or representative action or proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
Arbitration proceedings shall be conducted in Ontario, Canada under the applicable arbitration rules, unless otherwise agreed in writing by both parties.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to preserve the status quo pending arbitration.
By accessing this site and/or purchasing any Trademomo product or service, you agree that you will not:
Trademomo actively monitors public channels and will pursue all available legal remedies, including claims for defamation, tortious interference, and injunctive relief, against any individual who violates this provision. We take our reputation and the integrity of our community seriously and will protect both vigorously.

All Trademomo software, code, indicators, strategies, methodologies, content, branding, and proprietary systems are the exclusive intellectual property of Ellex Capital Inc. and are protected by applicable copyright, trade secret, and intellectual property laws.

Trademomo reserves the unconditional right to refuse, suspend, or terminate service to any individual at our sole discretion, including but not limited to situations where we determine that a user:
We are under no obligation to provide a reason for termination. Upon termination, access to all products and services will cease at the end of the current billing period. No refund will be issued.
You agree to indemnify, defend, and hold harmless Trademomo, Ellex Capital Inc., and their owners, directors, officers, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of our services or software; (b) your trading activity; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any claim by a third party arising from your conduct.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to the arbitration provision above, you consent to the exclusive jurisdiction of the courts of Ontario for any matters not subject to arbitration.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the site or services after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
